This will be a day long remembered. It has seen the end of the filibuster block on Judge Pryor and the confirmation of Judge Janice Rogers Brown, it will soon see the confirmation of more conservative, constitutionalist appellate court justices.
*excuse me for a moment* WWWWWOOOOOOOOOOOOHOOOOOOOOOOOOOOOOOOOOO!!!!!!! YES!! AHAHAHA!!!! WHEEEE!!! AHAHAHAHHA!!! WOOHOO!!! *ahem* And now we know we have majorities to confirm judges in the mold of Robert Bork and Antonin Scalia. Ever read Brown's speech before the Federalist Society? Google it. It is fabulous. And if this 14 senator coalition holds with Supreme Court nominees, we win. If it breaks, and the Democrats filibuster, we do the nuclear option and win. Ah, out of the mouths of babes.
Victories through the judiciary are often pyrrhic: They can speed a societal change that was going to happen anyways (integration), but when used on an issue where legalization will not shift the battle lines (i.e. abortion), such cases can be counterproductive; the public gets things they weren't clamoring for, and they react accordingly. If the "Constitution in Exile" is truly restored, as some would like, you'll see a massive backlash that'll add points to the Democratic column. Similarly, you had best hope Roe V. Wade stands, from a practical standpoint; losing Roe could cost the Republicans up to 10-15 points in statewide races. Judicial victories for the Republicans are probably the easiest way there is for Democrats to sweep back into office. Conservatism and liberalism isn't a 'front', it's not Red Sox Vs. Yankees, and it's not like an army that you 'advance'. It's a means to an end for the American people; something you'd do well to remember. Did you say that Janice Rogers Brown's got a badunkadunk? Anyhoo, Brown is quite possibly the most radical Judicial Activist out there. A Scalia or Thomas she ain't. Which is one of the most ironic parts of this whole judicial brouhaha, I think.
